IP Enforcement In China: Chint V. Schneider Electric

Law360, New York (October 09, 2007, 12:00 AM ET) -- Saturday, Sept. 29, 2007, marked dual milestones in IP enforcement in China. First, a record breaking damage award of $45 million was rendered for patent infringement. Second, it was rendered for a “small invention” patent. These are formally called “utility model” patents in China, and can be rapidly obtained simply through registration without elaborate examination.

French electrical company Schneider Electric was ordered to pay its Chinese rival Chint Group 333 million yuan (about $45 million U.S.) in damages for infringement of a Chinese utility model patent....
