Apple Says Motorola FRAND Dispute Belongs In Fed. Circ.

Law360, New York (February 8, 2013, 4:57 PM ET) -- Apple Inc. said Thursday the Federal Circuit has jurisdiction over the company's antitrust and breach of contract claims related to Motorola Mobility LLC's licensing of essential wireless patents, arguing that at least part of the dispute arose under federal patent law. 

Responding to a motion to dismiss filed by Google Inc.'s Motorola, Apple refuted its rival's contentions that the case belonged in the Seventh Circuit. Apple said that its claims for declaratory judgment in the suit arose under patent law, and so the Federal Circuit should...
