Law360, New York (March 01, 2006, 12:00 AM ET) -- Johnson & Johnson subsidiary Alza Corporation has been smacked with a class-action antitrust lawsuit, accusing the unit of illegally trying to keep generic versions of overactive bladder drug Ditropan XL off the shelf.
The suit, filed last Wednesday in U.S. District Court for the Northern District of California by the Teamsters Local No. 35 Health Plan, charged the Big Pharma with unfairly shutting competitors out of the marketplace.
“The result of the defendant’s unlawful conduct has been to obtain and extend their monopoly,” the complaint alleged....
