TiVo, Dish Headed To Bench Trial Over Patent

Law360, New York (November 21, 2008, 12:00 AM ET) -- A federal judge has ordered a bench trial to be held in February to determine whether Dish Network Corp.'s new software for its digital video recorders violates a patent held by TiVo Inc.

The Thursday ruling was a blow to TiVo, which filed a motion in June asking that Dish be held in contempt of court for failing to abide by a 2006 court order requiring the company to disable the DVR function of its receivers.
