Bayer Suit Over Generic Yasmin Gets The Boot

Law360, New York (September 29, 2010, 2:08 PM ET) -- A federal judge has ruled that Watson Pharmaceuticals Inc. and Sandoz Inc. won't infringe a Bayer AG patent by introducing a generic version of oral contraceptive Yasmin, saying the patent only covers off-label uses of the drug.

Judge Paul G. Gardephe of the U.S. District Court for the Southern District of New York granted the defendants' motion for judgment on the pleadings Tuesday, finding that the disputed claim of U.S. Patent 5,569,652 does not cover a use approved by the U.S. Food and Drug Administration....
