Challenge To Regional Carbon Trading Program Nixed In NY

Law360, New York (June 13, 2012, 10:55 PM ET) -- A New York state judge on Wednesday tossed a suit challenging a regional cap-and-trade initiative and alleging that the 10-state greenhouse gas-reducing effort is a tax on energy implemented in the state without legislative support.

Attorney General Eric Schneiderman successfully convinced the court that the plaintiffs had no legal ground to support the challenge to the Regional Greenhouse Gas Initiative regulations, and that the lawsuit was time-barred, according to his office.
