Miss. Farmers Try To Nix Bayer Tainted Rice Defenses

Law360, New York (October 20, 2009, 1:43 PM ET) -- Mississippi rice farmers in the multidistrict litigation against Bayer CropScience over genetically modified rice have asked a federal judge to dismiss two of Bayer's defenses that were already tossed in a related suit.

Black Dog Planting Co. and its partners filed a motion Monday asking the U.S. District Court for the Eastern District of Missouri to grant summary judgment against two of Bayer's affirmative defenses to allegations of negligence surrounding a genetically modified rice strain, asserting that they would not pass muster under Mississippi state law....
