Bayer Seeks To Toss Rice Farmers' Damage Claims

Law360, New York (October 30, 2009, 2:37 PM ET) -- With the first bellwether trial looming in multidistrict litigation over losses related to genetically modified rice in the long-grain rice industry, Bayer CropScience AG has asked a judge to throw out a group of rice farmers' claims for damages allegedly incurred after the 2008-2009 crop year.

In a motion for summary judgment filed Thursday in the U.S. District Court for the Eastern District of Missouri, Bayer called the damages calculations submitted by the so-called Bell Group plaintiffs “impermissibly speculative.”
