St. Jude Tries To Block BSC's Poached Worker Suit

Law360, New York (October 13, 2010, 5:18 PM ET) -- Medical device maker St. Jude Medical SC Inc. has asked a California judge to block a rebuttal suit filed in Minnesota by rival Boston Scientific Corp. over a poached salesman who claims that Boston Scientific hired him to sell defibrillators it knew to be defective.

St. Jude’s motion, filed Tuesday in the U.S. District Court for the Northern District of California, hinges on a disputed forum clause in an employment contract signed in July 2009 by Blair Kiland, a California-based internal defibrillator salesman.
