Law360, New York (January 06, 2011, 4:16 PM ET) -- A federal judge has rejected motions by Enerco Group Inc. to dismiss a putative class action alleging the company marketed vent-free home heaters that shot out hazardous sparks.
Enerco and co-defendant CSA America Inc., which certified the heaters were compliant with American National Standards Institute safety guidelines, failed to prove the plaintiffs lacked standing to bring their complaint, according to Wednesday’s ruling from Judge Dan Aaron Polster of the U.S. District Court for the Northern District of Ohio.
