7th Circ. Shuts Down Abbott Workers' Benefit Appeal

Law360, New York (February 03, 2012, 3:04 PM ET) -- The Seventh Circuit on Friday refused to revive a proposed class action brought by former Abbott Laboratories Inc. workers, finding the drugmaker did not intentionally interfere with employee pension benefits in a 2004 spinoff of generic division Hospira Inc.

In a unanimous decision, the appeals court affirmed an Illinois federal court judge’s ruling that Abbott’s decision to spin off Hospira, its hospital products division, in 2004 did not violate the Employee Retirement Income Security Act.
