Law360, New York (May 01, 2012, 7:59 PM ET) -- A group of sulfuric acid producers urged the Seventh Circuit Monday to rule that a class of plaintiffs accusing them of restricting output after signing distribution deals with a Canadian company to keep prices high should have to prove that the deals harm competition.
The defendants asked the appeals court to uphold the district court's decision that the so-called rule-of-reason test — which requires plaintiffs to demonstrate that the anticompetitive effects of an agreement outweigh the procompetitive ones — was appropriate in the long-running case....
