Class Cert. Denied In Toxic Water Suit Against Ill. Town

Law360, New York (May 17, 2012, 7:39 PM ET) -- An Illinois state judge on Monday denied class certification to former and current residents in their suit against the village of Crestwood, Ill., over contaminated water that they say made them sick, ruling that individual claims predominate over any common issues. 

The consolidated suit, brought by plaintiff Charlene Earley on behalf of Crestwood residents, accuses the 11,000-resident village, former Mayor Chester Stranczek and current Mayor Robert Stranczek of supplying the town with contaminated tap water partially drawn from a well polluted with perchloroethylene, a solvent which breaks...
