Ohio Hospital System Claims Immunity From Antitrust Attack

Law360, New York (May 30, 2012, 5:24 PM ET) -- Ohio health system Premier Health Partners urged a federal judge Tuesday to toss an antitrust suit from a small local rival, arguing that the nature of its four-hospital partnership makes it invulnerable to the suit's Sherman Act claims.

The plaintiff, the Medical Center at Elizabeth Place, claims that the group of four health care providers, integrated through a joint operating agreement, used their market share in the Dayton area to coerce managed care plan providers to refuse access to their hospital.
