Apple, Motorola Clash Over Damages-Free Smartphone Trial

Law360, New York (June 06, 2012, 7:58 PM ET) -- Motorola and Apple Inc. sparred Wednesday over whether their imminent smartphone patent trial should still be held if a judge rules they are not entitled to damages, with Apple saying it should go ahead and Motorola saying the trial should be canceled.

Motorola told an Illinois federal court that when no form of relief is available, a court cannot hold a trial merely to determine whether a patent is infringed or invalid, citing a ruling that held that "psychic satisfaction is not an acceptable remedy."...
