Law360, New York (September 19, 2007, 12:00 AM ET) -- A federal judge overseeing the multidistrict litigation over cholesterol-lowering drug Baycol has agreed to allow plaintiffs to pursue an interlocutory appeal over an order relating to expert testimony.
On Monday, Judge Michael J. Davis of the U.S. District Court for the District of Minnesota certified the plaintiffs’ order for interlocutory appeal. The plaintiffs can now appeal Judge Davis’ July 16 order, which granted in part Bayer AG and GlaxoSmithKline’s request to exclude particular testimony from all 10 of the plaintiffs’ expert witnesses.
