Law360, New York (June 30, 2012, 2:53 PM ET) -- A federal judge in Illinois denied on Thursday a motion by Oleg Cassini Inc. to end a lawsuit filed by Serta Inc. seeking a ruling that the bedding maker's “Perfect Day Cassini” mattresses didn't infringe OCI's trademark.
U.S. District Judge Robert M. Dow Jr. rejected the fashion house's argument that Serta had improperly filed the lawsuit, in November 2011, to get the upper hand before Cassini could file a suit of its own.
