Law360, New York (March 16, 2009, 12:00 AM ET) -- The plaintiffs in the multidistrict litigation over Medtronic Inc.'s Sprint Fidelis defibrillator leads have revised their proposed pleadings in light of the U.S. Supreme Court’s ruling in Wyeth v. Levine.
Earlier this month, Judge Richard H. Kyle of the U.S. District Court for the District of Minnesota approved the plaintiffs’ bid to file a revised proposed amended complaint. The decision to allow revisions to the proposed amended complaint followed Judge Kyle's decision to toss all 21 claims in the suit in January.
