Judge Rules Vioxx Claims Should Be Tried Separately

Law360, New York (November 23, 2006, 12:00 AM ET) -- Pharmaceutical giant Merck & Co Inc. will not face a nationwide class action suit over wrongful death and personal injury claims stemming from the use of Merck’s blockbuster painkiller Vioxx, a federal judge in New Orleans has ruled.

Last Tuesday, U.S. District Judge Eldon Fallon signed a 25-page Order & Reasons denying the plaintiffs’ request to certify a nationwide class of personal injury and wrongful death claimants who contended Vioxx harmed them.
