Law360, New York (May 10, 2012, 10:57 PM ET) -- A California federal judge on Thursday dismissed a putative class action accusing Apple Inc. of selling iPhones with defective reception meters prior to a software upgrade in July 2010, finding the phone purchasers had failed to adequately plead allegations of fraud.
Although he rejected several of Apple's arguments, U.S. District Judge Ronald M. Whyte granted the motion to dismiss without prejudice and with leave to amend, with the exception of a California law-based warranty claim and a claim for restitution, which he dismissed with prejudice....
