Merck, Patient Seek Separate JMOL In Fosamax Trial

Law360, New York (September 01, 2009) -- Pharmaceutical giant Merck & Co. Inc. has asked a federal judge to dismiss the remaining claims in a product liability and personal injury case over its osteoporosis drug Fosamax, while the consumer who claims that Fosamax caused her to develop a degenerative bone disease has moved for partial judgment on several of Merck's affirmative defenses.

Merck filed its amended motion for judgment as a matter of law Tuesday, and plaintiff Shirley Boles requested a partial JMOL Monday from Judge John F. Keenan in the U.S....
