Enforcing Subpoenas In Section 337 Proceedings

Law360, New York (October 06, 2009) -- A party wishing to enforce a subpoena against a third party in a Section 337 Investigation should be familiar with the process outlined by the U.S. International Trade Commission rules and the statute governing the ITC's ability to obtain information, 19 USC §1333.

While the statute authorizes the ITC to issue subpoenas, in the event of noncompliance, the ITC must seek the assistance of a federal district court to enforce the subpoena....
