Law360, New York (October 02, 2009) -- A unit of Massey Energy Co. has suffered yet another blow in its long-running battle with unionized miners, with the National Labor Relations Board affirming a judge's order that the company unlawfully discriminated on the basis of union status by refusing to rehire the employees when it acquired a bankrupt rival.
