Sanctions Excessive In ClearValue Suit: Fed. Circ.

Law360, New York (March 25, 2009) -- The U.S. Court of Appeals for the Federal Circuit has revived a patent suit filed by water treatment company ClearValue Inc. against rival Pearl River Polymers Inc., finding that the district court's dismissal of the case and imposition of over $2.7 million in sanctions against ClearValue for concealing evidence during discovery were excessive.

Judge Alvin A. Schall of the Federal Circuit on Tuesday also reversed the finding that Gordon Waggett, who represented ClearValue throughout the litigation, should be held liable along with ClearValue....
