Law360, New York (May 20, 2010, 1:06 PM ET) -- “March Madness” took on a new meaning for employers saddled with Sarbanes-Oxley (SOX) whistleblower litigation before the U.S. Department of Labor (DOL). In March 2010, the Occupational Health and Safety Administration (OSHA) issued awards in two SOX cases totaling over $1,600,000, along with reinstatement orders. And the Administrative Review Board (ARB) reversed the dismissal of a SOX complaint. April Fools’ Day wasn’t any better for management, as an Administrative Law Judge (ALJ) issued an order providing reinstatement, backpay and attorneys’ fees in a closely watched case....
