Fraud Claims Live Against Biovail Execs In SEC Case

Law360, New York (February 11, 2009, 12:00 AM ET) -- The U.S. Securities and Exchange Commission can go forward with a securities fraud case against former Biovail Corp. executives Brian Crombie, John Miszuk and Kenneth G. Howling, a federal judge has ruled, despite the defendants’ contentions that the agency does not have enough facts to support its claims.

Judge Lewis A. Kaplan issued an order Tuesday in the U.S. District Court for the Southern District of New York denying motions to dismiss filed on behalf of the executives.
