Court Will Use Advisory Jury In FEMA Trailer MDL

Law360, New York (July 06, 2009, 12:00 AM ET) -- A federal judge has said that an advisory jury will hear evidence against the U.S. government despite its objections, in bellwether trials in a multidistrict litigation accusing the government and manufacturers of providing hurricane victims with formaldehyde-laden trailers.

An advisory jury, whose decisions are not binding, is reasonable and does not contravene the Federal Tort Claims Act, Judge Kurt D. Engelhardt of the U.S. District Court for the Eastern District of Louisiana said in a motion issued Thursday.
