Law360, New York (August 11, 2009, 1:24 PM ET) -- Citing a pollution exclusion, a federal judge has ruled that insurer Century Indemnity Co. is not required to defend or indemnify Florida's Duval County School Board for damages related to a settlement in an environmental lawsuit.
Judge Harvey E. Schlesinger's ruling, issued Friday in the U.S. District Court for the Middle District of Florida, characterized the school board's arguments in the case as a "last-ditch effort to find any sort of coverage" to fund a multimillion-dollar settlement that concluded an underlying environmental contamination class action....
