Law360, New York (October 23, 2009, 4:37 PM ET) -- A federal appeals court has revived a pension fund's withdrawal liability claim against International Comfort Products LLC, finding that labor law can require an entity to pay into a pension fund even when it isn't bound to contribute by a contract.
The U.S. Court of Appeals for the Sixth Circuit on Friday vacated a judge's ruling that dismissed the Central States, Southeast and Southwest Areas Pension Fund's Multiemployer Pension Plan Amendments Act claim against International Comfort Products, a subsidiary of United Technologies Corp.
