Widow Gets Chance To Receive "Black Lung" Benefits

Law360, New York (November 09, 2006, 12:00 AM ET) -- A woman who was denied survivor’s benefits under the Black Lung Benefits Act after her husband died from working in coal mines for 36 years has been given a second chance by the Fourth Circuit Court of Appeals.

On Wednesday, Nora Collins’ case was reversed and remanded back to the Benefits Review Board.

Collins’ late husband, Johnny Collins, had worked underground in the coal mines of southern West Virginia and eastern Kentucky as an operator of a cutting machine, a motor, and a loading machine....
