D-Back Accuses Defenshield Of False Patent Marking

Law360, New York (November 12, 2010, 2:04 PM ET) -- D-Back Acquisition Co. has accused rival armor maker Defenshield Inc. of falsely marking its bulletproof barriers and using the patent to sabotage the plaintiff’s lucrative contract with the U.S. Army.

The complaint, filed Wednesday in the U.S. District Court for the Western District of North Carolina, claims Defenshield has falsely marked its mobile ballistic shields and interfered with the government contract by filing a frivolous infringement action against rival products now belonging to D-Back.
