Fed. Circ. Nixes Google Attys' Fees Award In IP Suit

Law360, New York (January 11, 2011, 3:49 PM ET) -- The Federal Circuit has reversed a judge's decision to award Google Inc. $650,000 in attorneys’ fees for what he called an objectively baseless patent infringement claim.

Google Inc. did not infringe iLOR LLC’s patent for an automatic toolbar rising out of a hyperlink, the U.S. Court of Appeals for the Federal Circuit said, but iLOR’s claim had arguable merit, and the district judge went too far in ordering iLOR to reimburse the Internet giant’s attorneys’ fees, Judge Timothy B.
