Law360, Washington (July 01, 2011, 1:28 PM ET) -- The Fifth Circuit on Thursday asked the Texas Supreme Court to weigh in on two questions of state law in a fight over insurance coverage for a nonprofit organ and tissue donation company facing a contract suit alleging it gave donated organs to for-profit companies to sell.
“This Texas law diversity case involves important and determinative questions of Texas law as to which there is no controlling Texas Supreme Court precedent,” a three-judge panel of the appeals court said.
