Law360, New York (May 10, 2012, 7:40 PM ET) -- The Sixth Circuit on Thursday refused to resurrect an ex-store manager's lawsuit against AT&T Mobility LLC claiming he was sexually harassed by a male supervisor who called him a necrophiliac, ruling the plaintiff hadn't established that his gender had prompted the alleged mistreatment.
A three-judge panel issued a published opinion affirming a trial court's ruling that the conduct of Jeffrey Kalich's immediate supervisor was "crude" and "despicable," but not actionable under the sexual harassment hostile work environment provisions of Michigan’s Elliott-Larsen Civil Rights Act.
