Law360, New York (June 12, 2008, 12:00 AM ET) -- A cell phone company in England was within its rights to use a rival's trademarked bubble logo in a 2004 advertisement, Europe's highest court has ruled.
O2 Holdings Ltd., the U.K.'s biggest wireless provider, sued Hutchison 3G U.K. Ltd. over a 2004 television ad that used the names and logos of competitors to compare their prices with Hutchison's. O2 has long used bubbles in its ads and objected to Hutchinson's use of bubbles in the spot.
