Law360, New York (May 03, 2011, 9:28 PM ET) -- The Fourth Circuit on Tuesday revived Novell Inc.’s antitrust action against Microsoft Corp., finding Novell is free to pursue claims over WordPerfect and other software applications even though the defendant settled a related suit with another company for $280 million.
In an unpublished split decision, the Fourth Circuit ruled that Novell’s sale in 1996 of its desktop operating system business to Caldera Inc. did not prevent it from seeking billions of dollars from Microsoft for allegedly using its monopoly power to crush Novell’s office productivity applications....
