Tobacco Cos.' Suit Over FDA Science Panel Picks Proceeds

Law360, New York (August 01, 2012, 4:29 PM ET) -- A Washington federal judge on Tuesday allowed two tobacco companies to move ahead with a suit against the U.S. Food and Drug Administration seeking to remove allegedly biased members from a tobacco science committee, rejecting the FDA's arguments that the plaintiffs lack standing.

U.S. District Judge Richard J. Leon said that Lorillard Inc. and R.J. Reynolds Tobacco Co. have shown injury from FDA's actions and found that the companies' conflict of interest challenges are subject to judicial review under the Administrative Procedure Act.
