Keystone XL Can Use Eminent Domain, Texas Judge Says

Law360, New York (August 23, 2012, 7:27 PM ET) -- A Texas judge ruled late Wednesday that TransCanada Corp.'s Keystone XL pipeline has the right to seize land to complete its route to the Gulf Coast, ending a six-month challenge by a farm owner and dealing a blow to environmental groups and landowners who oppose the pipeline.

In a 15-word ruling sent from his iPhone, Judge Bill Harris agreed with TransCanada that the pipeline is indeed a “common carrier,” which gives it the right of eminent domain in exchange for allowing third-party oil producers to use...
