Law360, New York (August 27, 2012, 6:54 PM ET) -- The Second Circuit ruled Monday that Web-based streaming television services are not entitled to compulsory licenses for rebroadcasting TV content, affirming the shutdown of Internet TV company Ivi Inc. and handing a victory to CBS Broadcasting Inc., NBC Studios Inc., Fox Television Stations Inc. and others.
The appeals court determined that Internet TV companies were not "cable systems," and Congress didn't intend to force the networks to license their programming to web channels when it wrote the the Copyright Act of 1976.
