Law360, New York (March 16, 2011, 2:53 PM ET) -- New provisions in the recently enacted Food Safety Modernization Act, Public Law 111-353, unintentionally create foreign bribery risks for foreign importers of food.
The act will require importers of food to have a certification that an “article of food complies with applicable requirements” of the act. The act envisions that such certifications will be issued by “an agency or a representative of the government of the country from which the article of food at issue originated” or designated third-party auditors.
