Law360, New York (November 03, 2011, 4:25 PM ET) -- The Eighth Circuit refused Thursday to rehear a decision upholding the denial of a new trial to a former Agriprocessors Inc. CEO convicted of 86 counts of financial fraud following a sweeping immigration raid on a kosher slaughterhouse in Iowa.
The appeals court denied Sholom Rubashkin's petitions for a rehearing en banc or by panel in a three-sentence order, leaving intact a three-judge panel's Sept. 16 ruling that upheld a lower court's denial of a new trial to the convicted ex-CEO.
