Special Ed Teacher Can Claim Retaliation: 9th Circ.

Law360, New York (October 27, 2009, 3:27 PM EDT) -- A traveling teacher of students with disabilities in California has standing to bring an employment discrimination and retaliation lawsuit against the Riverside County Office of Education, a federal appeals court has ruled, reversing a lower court.

Friday's ruling in the U.S. Court of Appeals for the Ninth Circuit said teacher Susan Lee Barker has standing to sue under the Americans with Disabilities Act and the Rehabilitation Act and ordered the U.S. District Court for the Central District of California to take up the case anew....
