Queens Caterer Russo's Faces OT, Retaliation Action

Law360, New York (March 30, 2010, 1:22 PM EDT) -- A former line cook has joined a recently filed proposed collective action against Queens, N.Y., catering hall Russo's on the Bay, alleging the company fired him because he sought unpaid overtime.

The plaintiffs added Carlos Gaviria-Ramirez in an amended complaint filed Monday in the U.S. District Court for the Eastern District of New York, which continues to allege the Howard Beach establishment, also called T.A.R. Catering Corp., violated the Fair Labor Standards Act and the New York Labor Law.
