Dow, Terminix Not Liable For Birth Defects: 8th Circ.

Law360, New York (December 13, 2010, 5:06 PM EST) -- A federal appeals court has affirmed a lower court ruling that Dow Chemical Co. and Terminix International Co. are not liable for birth defects allegedly caused to a woman's son by an insecticide.

The U.S. Court of Appeals for the Eighth Circuit on Thursday affirmed a district court's decision to grant summary judgment on Rene Junk's claims against the companies, but ruled that Junk could pursue claims against Terminix employee Jim Breneman — who allegedly told the family the chemical was safe — in state court....
