Kuwaiti Co. Takes Fraud Summons Fight To 11th Circ.

Law360, New York (April 12, 2011, 6:02 PM EDT) -- A Kuwaiti company accused of overcharging the U.S. military $70 million for food delivered to American troops took its case to the Eleventh Circuit on Monday, saying a lower court's judge unfairly affirmed a criminal summons against it.

The Public Warehousing Co. and its U.S. subsidiary, Agility DGS Holdings Inc., are appealing a district judge's ruling that prosecutors properly served the summons on Agility DGS Holdings as an "alter ego" of its parent company.
