Black & Decker Wage Case Revived By 2nd Circ.

Law360, New York (May 5, 2011, 4:01 PM EDT) -- The Second Circuit on Thursday reinstated a portion of a New York class action filed against Black & Decker (U.S.) Inc. by retail specialists who allege the power tool manufacturer bilked them on payment for overtime hours worked but not recorded.

A three-judge panel of the U.S. Court of Appeals for the Second Circuit said plaintiff Greg Kuebel had raised genuine issues of material fact on his off-the-clock overtime claims.
