FedEx, Plaintiffs Spar Over Driver Declarations In MDL

Law360, New York (August 28, 2007, 12:00 AM EDT) -- The plaintiffs in multidistrict litigation alleging FedEx Ground Package System Inc. misclassified employees as independent contractors to deprive them of benefits are fighting a bid to have the court re-examine its decision to strike 293 declarations.

The plaintiffs filed papers on Monday opposing FedEx Ground's motion for reconsideration of U.S. Magistrate Judge Christopher Nuechterlein's July 23 order granting a motion to strike FedEx's driver declarations.
