Nat'l Union Entitled To $3M Fees In Valero Defense: 5th Circ.

Law360, New York (May 31, 2012, 9:03 PM EDT) -- The Fifth Circuit said Wednesday that National Union Fire Insurance Co. is entitled to recover $3 million it spent defending Encompass Power Services in a dispute over a 2002 fire at Valero Refining Co., despite claims from three primary insurers that the excess insurer had no right to reimbursement.

The court found that National Union is entitled to reimbursement for the $3 million it spent to defend Encompass Power Services when Valero invoked contractual arbitration against Encompass, accusing it of negligence in designing, engineering and constructing...
