France Targeted For Noncompliance With Energy Rule

Law360, New York (October 18, 2007, 12:00 AM EDT) -- France is being targeted by the European Commission after allegedly failing to comply with a Court of Justice decision that ordered it to provide evidence concerning its compliance with a 2003 competition directive that extended existing minimum tax rates to natural gas and electricity providers.

The infringement proceedings were formally announced to France via a letter under Article 228 of the EC treaty. After considering the matter, the EC may choose to refer the issue to court once more and recommend penalties, the EC said Thursday....
