Dukes Doesn't Bar Nurses' OT Collective Action, Judge Says

Law360, New York (June 20, 2013, 10:08 PM EDT) -- An Ohio federal court granted a group of nurses' bid for collective action certification Thursday in their lawsuit alleging Liberty Healthcare Corp. shorted them on overtime pay, despite Liberty's argument that the U.S. Supreme Court's landmark Dukes decision raised the bar for Fair Labor Standards Act plaintiffs.
